we have that law taking effect in chicago. my wife has high sensitivity to smoke, so she's not much fun to take at smokey bars. i just hate the after-smell of them on my clothes.
what they should do is offer a lift on the ban for bars that pay a certain amount, and have that amount go toward something civic-minded (like cleaning butts off the street; or cleaning bums. either way, it's all good). then people can choose to go to a smoker's bar or a smoke-free bar.
THSE - Bartenders and waitrons choose to work in those environments. And that's all I'll have to say about that.
jasdye - Believe me, I benefited from Columbus's ban in that I'd rather be in a smoke-free environment. I guess I just favor personal liberty (for individuals and businesses) more than my preferences.
As for your proposal, I say let the free market decide.

Yeah, it's the one that bans smoking EVERYWHERE. Even bastions for health conscious, like bars and tobacco stores.
Yeah, surprisingly I'm not so much a fan of those. Or maybe not surprisingly.
I can dig the smoking ban; I'd hate to see my non-smoking bartenders or barbacks develop respiratory ailments down the road.
Tobacco stores, on the other hand...c'mon that's a no-brainer.
